Legal Advocacy

Legal advocacy services include presenting or arguing a client’s case to various officials, providing legal advice, legal counseling and pleading a case in court. Legal advocacy is not a full legal service, therefore legal advocates do not assume the role of attorneys. However, they often provide assistance and support to clients during court processes. For example, they may attend court on the behalf of an addict to plead a case and provide evidence they are undergoing addiction treatment.

Legal advocacy is available to clients with mental illness, addictions, physical and mental disabilities and victims of domestic abuse. Many organizations have legal advocacy programs devoted to their respective mission.

Core Elements of Legal Advocacy

Education: Discrimination is often the result of decision-makers’ ignorance about a disability, whether it is mental or physical. Many programs incorporate education to prevent discrimination or stop ongoing discrimination.

Negotiation: Some legal advocacy programs provide the tools necessary to negotiate resolutions or to pursue litigation when education efforts fail to resolve problems. These tools help people understand their rights; learn how to effectively utilize elected officials, media, and grassroots means to counter discrimination and provide access to lawyers, mental health and healthcare professionals.

Litigation: Many larger organizations have the resources to train lawyers, provide litigation resources and even file discriminatory cases.

Legislation: Some larger organizations also have the resources to enact legislative changes at the local, state and national levels. They can work through the legislative and regulatory processes and help people with various disabilities.

Legal issues handled by legal advocates cover several major categories, including:

Housing: A client is unable to obtain affordable housing because of disability discrimination, denial of public housing assistance, foreclosure, eviction or failure by a landlord to maintain the premises.

Benefits: A client is unable to access public benefits such as nutrition assistance, Medicare/Medicaid or SSI/Disability Income.

Financial or Mental Health Issues: A client suffers instability because of consumer issues such as predatory lending, auto-loan scams, excessive and/or “zombie” debt or unfair debt collection practices. The client may also suffer financially due to loss of work related to employment discrimination.

Legal representation: A client requires representation in family court because of potential termination of parental rights or changes in parental or custodial rights. They may also need representation related to DUIs, theft, drug charges or more serious offenses. A legal advocate can also coordinate powers of attorney (including healthcare) and healthcare advanced directives.

Immigration: A client requires assistance with immigration issues including family reunification, status issues or human trafficking violations.

Legal advocacy program often help clients struggling with substance abuse or mental illness continue to receive therapeutic treatment in the community, rather than face unjustified incarceration.
